This website is operated by Health Screening NZ. Throughout the site, the terms “HSNZ,” “we,” “us,” and “our” refer to Health Screening NZ. Our appointment scheduler is hosted by Squarespace. They provide us with an online booking platform, which allows us to offer you appointments and services.

 

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices.

HSNZ is not responsible for any inaccuracies or data loss resulting from technical issues or interruptions in network service that may affect the transmission of biometric or health data. We recommend that users ensure secure and stable internet access when accessing services online.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided without express written permission from us.

 

PRIVACY AND PERSONAL DATA

Your privacy is important to us. Any personal information that you submit through the store or the scheduling service is governed by our Privacy Policy. Our Privacy Policy details how we collect, use, and protect your personal data, including but not limited to biometric and health data. We comply with the Health Information Privacy Code 2020, which ensures that your health data is treated with the highest standard of privacy and care.

Biometric and health data collected during screenings will be securely stored and accessible only to authorised personnel. HSNZ does not share personal health information with third parties unless required by law or with express user consent. For more information, please see our Privacy Policy

INFORMED CONSENT

By using the HSNZ cardiovascular screening service, you confirm that you understand the nature and purpose of the service, including that it is intended solely for cardiovascular risk assessment and is not a substitute for medical advice or diagnosis. By booking a screening, you provide your informed consent to participate in the service, understanding its scope and limitations.

 

CONSUMER GUARANTEES ACT

Nothing in these Terms of Service limits or excludes your rights under the Consumer Guarantees Act 1993 (CGA). If you are acquiring our services for personal use, your rights under the CGA apply. This means that you are entitled to services that are delivered with reasonable care and skill, fit for purpose, and provided within a reasonable timeframe. If the services do not meet these requirements, you may be entitled to remedies, including a refund or replacement.

 

FAIR TRADING ACT

We comply with the Fair Trading Act 1986 (FTA). All representations of our services and products are accurate and in accordance with New Zealand law. Should you feel that any information is misleading, you are entitled to remedies as provided under the FTA.

 

ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete, or current. PRODUCTS OR SERVICES

Health Screening NZ uses the CardiAction product, combined with the BP+ Machine from Uscom, as part of its cardiovascular screening services. The BP+ Machine is used to capture arterial waveforms and other biometric data, which the CardiAction algorithm then analyses to assess cardiovascular health risk. By using our services, you acknowledge that the BP+ Machine and CardiAction system are intended as tools for cardiovascular risk assessment and are not substitutes for medical advice, diagnosis, or treatment.

Customers are encouraged to seek follow-up medical advice from a healthcare professional based on the screening results. The screening results provided by HSNZ are based on data collected via the BP+ Machine and during the consult, and while these results can indicate a potential cardiovascular risk, they should not be used as the sole basis for medical decisions.

Certain products/services or discounts may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We reserve the right to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations or that any errors in the Service will be corrected.

 

ONLINE PAYMENTS

Payments made through the website are processed by Stripe. By using the Stripe Checkout service and entering your card details, you agree to be bound by the terms and conditions of Stripe available https://stripe.com/nz/checkout/legal

By booking through this website, you authorise HSNZ to send instructions to your financial institution to take payments from your card. This is a one-off payment for the value accepted by you when confirming the appointment.

 

APPOINTMENT AND REFUND POLICIES

Bookings can be changed free of charge up to 12 hours before the appointment. Changes within 12 hours of the appointment are not permitted without express consent from HSNZ.

Cancellations are permitted free of charge up to 24 hours before the appointment. No refunds will be given for cancellations made within 24 hours of the appointment.

Refunds may be voided if the service is partially completed or if user-provided data is incomplete or inaccurate. HSNZ is not liable for any cancellations or service disruptions caused by technical issues on user devices or third-party service providers.

We reserve the right to amend our rescheduling and cancellation policy at any time. Rescheduling and cancellations can be managed through the link in your confirmation email.

Refunds will be processed through Stripe and may take up to 7 working days.

If you believe the service provided did not meet your expectations or was not provided with reasonable care and skill, you may be entitled to a refund or other remedy under the Consumer Guarantees Act.

 

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

You agree to provide current, complete, and accurate purchase and account information for all purchases made through our store. You agree to promptly update your account information to enable us to complete your transactions and contact you as necessary.

Certain content, products, and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for the accuracy or content of third-party websites.

 

SOCIAL MEDIA POLICY

We curate all content published on our social media channels and retain editorial rights over content submissions. Our social media channels are intended to be positive and safe spaces for our clients and colleagues to share and enjoy content. We reserve the right to delete any comment which goes against this mutual code of conduct. Any customer service inquiry will be directed to private channels so that we can resolve these matters personally.

Occasionally, there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend, or clarify information in the Service or on any related website except as required by law.

Health Screening NZ uses the CardiAction product along with the BP+ Machine from Uscom as part of its cardiovascular screening services. While the BP+ Machine has been verified for accuracy and the CardiAction algorithm is based on extensive research, the results are intended as a risk assessment tool only and are not a substitute for professional medical advice, diagnosis, or treatment. HSNZ does not assume liability for any decisions made based on these results.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless HSNZ and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable lawyers’ fees, made by any third party due to or arising from your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand.
